The Tox Holdings Corporation (the “Tox”, “we”, “our”, or “us”) respects the right to privacy of all users of thetoxtechnique.com (the “Tox Site”) and all users of the services of the Tox (the “Tox Services”). The Tox is committed to keeping any and all collected information and information that you provide to us confidential, secure and private. This statement explains our information practices.
This Privacy Policy shall govern any and all data collection and usage through the use of the Tox Site and the Tox Services. By using the the Tox Site and/or the Tox Services, you acknowledge that you agree with this Privacy Policy. In addition, your continued use of the Tox Site and/or the Tox Services following the posting of any updates or changes to our terms and conditions shall mean that you are in agreement and acceptance of such changes. If you do not agree with this Privacy Policy, please do not provide us with any Personal Information (as defined below) and please refrain from using the Tox Site and the Tox Services.
Information Collected
The Tox collects information that you provide to us. Examples of personal information that we collect may include, but are not limited to your name, address, telephone number, email address, birth date, gender, race, payment information, health information that you provide to the Tox, and other personally identifiable information (collectively, the “Personal Information”). The Tox Site shall only collect Personal Information that you knowingly and willingly provide, (i.e. by way of surveys, completed membership forms, and emails). It is the intent of the Tox Site to use Personal Information only for the purpose for which it was requested and any additional uses specifically provided on the Tox Site.
The Tox may collect information from a third party, including an affiliated professional health care provider or esthetician about your treatment options provided to you and your results.
The Tox collects other information from users of the Tox Site that is not characterized as Personal Information, such as IP addresses, browser types, location information and operating system types to assist us in providing and maintaining superior quality service.
Google Analytics
The Tox uses a tool called “Google Analytics” to collect information about use of the Tox Site. Google Analytics collects information such as how often users visit the Tox Site, what pages they visit when they do so, and what other sites they used prior to coming to the Tox Site. We use the information we get from Google Analytics only to improve the Tox Site. Google Analytics collects only the IP address assigned to you on the date you visit the Tox Site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Tox Site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Tox Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to the Tox Site by disabling cookies on your browser. Please see Section titled “Cookies”.
Uses of Your Information
The Tox may use your Personal Information to provide, and to communicate with you about the Tox Services and the services offered by our service providers that treat you. We may transfer this Personal Information to our service providers, or other persons or entities working on your behalf. The Tox also may transfer this Personal Information, as well as other information collected on the Tox Site, to outside contractors, auditors, consultants or others engaged by The Tox to assist in providing financial or operational activities on the Tox’s behalf, including technical and processing services and analysis of the Tox Site performance.
Occasionally your Personal Information may be used for sending communications to you in relation to the Tox Services. Your email address may be used for marketing purposes, but no information regarding any services the Tox provides to you will be disclosed. The Tox may also be in contact with you regarding completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered. The Tox does not sell, trade or rent your identifying information with third parties unless we receive your prior permission or we are required to do so by law, or we have a good faith belief that such disclosure is necessary to comply with a current judicial proceeding, a court order, a legal process served on the Tox or to resolve any potential fraud or perceived irregularity in any audits of the accuracy of any documentation or information submitted to the Tox by you or on your behalf, as deemed appropriate by the Tox.
The Tox may be required or permitted by law to share your personal and protected health information, without prior notice to you, under certain circumstances including reporting adverse reactions to certain items, product recalls, preventing disease and for health research purposes. In accordance with applicable laws and/or in a good faith effort, the Tox may disclose your Personal Information, without prior notice to you, to maintain, safeguard and/or preserve all the rights and/or property of the Tox and perform under demanding conditions in an effort to safeguard the personal safety of users of the Tox Site and/or the general public.
Cookies
The Tox may use “cookies”, or small text files that are stored on your computer’s hard drive. Cookies ensure that the Tox Site’s content is presented in the most effective manner for you and your computer. You can decline cookies by activating a setting on your browser. If you choose to decline cookies, this may limit the functionality of the Tox Site. While we use cookies, we do not track our users across websites or over time. Many web browsers allow for the use of a “Do Not Track” function to inform websites that you do not want your online activities tracked. The Tox Site currently does not recognize the various web browser “Do Not Track” signals.
Security Methods
The Tox has implemented commercially reasonable physical, technical and administrative security measures to protect your Personal Information, including a secure firewall and use of security infrastructure. As an additional security measure, your Personal Information is also encrypted during transmission using SSL security, an industry standard secure technology. SSL encryption is indicated on your Web browser by the display of a lock or key on the browser status bar. Nonetheless, the transmission of information via the Internet is not completely secure. Therefore, we cannot guarantee the security of the data sent to us electronically and transmission of the data is entirely at your own risk.
Storage of Personal Information in the United States
All of the information that you provide to The Tox will be stored and processed in the United States. While you may access the Tox Site from a location outside of the United States, you agree not to transfer any of your information to us from outside the United States. The laws in the United States may not offer the same degree of privacy protection as the laws in your jurisdiction. The Tox does not currently store any data or member information outside of the United States.
Children
The Tox does not knowingly or specifically collect Personal Information from users under the age of 13 and no one under age 13 is authorized to submit any information, including Personal Information, on the Tox Site. If you are a minor over age 13, some portions of the Tox Site will require consent from your parent or guardian before you may use it. Parents or legal guardians of children under age 13 cannot agree to these terms on their behalf. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we will delete that information from our system's database.
Links To Other Websites
The Tox Site contains links to other websites that have information we believe may be of interest. We do not endorse these sites. We do not monitor, control, or endorse the privacy practices of any third parties and we are not responsible for the content of the sites or privacy practices employed by other sites. We encourage you to read the privacy policy of each site you visit that may collect information or ask you to disclose Personal Information. This Privacy Policy does not apply to information collected on external websites that may be linked to or through the Tox Site.

Right to Deletion
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

· Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected such information. Any information collected from you to verify your identity in connection with your request will be used solely for purposes of such verification.
If your information has been shared with a third party, as described elsewhere in this Privacy Policy, then that third party has received its own copy of your data. If you have been contacted by one of these third parties and wish to correct or delete your information, please contact them directly.
All users and/or visitors to our website have the option to discontinue receiving communication from the Tox and/or reserve the right to discontinue receiving communications by way of email or newsletters. Retention of Information
The Tox may retain your Personal Information for as long as we deem reasonable or as long as required by law.

The Tox reserves the right to modify, expand or remove all or any portion of this Privacy Policy at any time. Changes to this Privacy Policy will be posted on the Tox Site. Your continued use of the Tox Site and/or the Tox Services indicates your agreement with these modifications and updates.
